1. Agreement to Terms

Kinetic GPR (gprkinetic.pro) is a pilot-ready, pre-revenue rail subsurface intelligence platform. These Terms govern your use of open demos, corridor briefing requests, pilot programs, and related services offered by Kinetic GPR ("we," "us" or "our").

2. Intellectual Property Rights

Unless otherwise indicated, the platform is our proprietary property and all source code, databases, functionality, software, website designs, AI models (including but not limited to our PyViTENet and XGBoost implementations), audio, video, text, photographs, and graphics on the platform (collectively, the "Content") and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.

3. User Representations

By using the platform, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you have the legal capacity and you agree to comply with these Terms of Service; (3) you will not access the platform through automated or non-human means without our express permission, whether through a bot, script, or otherwise.

4. AI Analysis Disclaimer

Kinetic GPRvides rail subsurface intelligence from ground penetrating radar data during pilot and demo use. Analysis, BFI proxies, and structural health indices are provided for informational and planning purposes only — not as certified engineering deliverables at production scale today.

Our analysis does not replace the requirement for a licensed Professional Engineer (PE) or certified geophysicist to validate critical infrastructure decisions. Kinetic GPR shall not be held liable for any structural failures, derailments, or damages arising from reliance on our automated reporting.

5. Data Ownership and Licensing

You retain ownership of the raw GPR data you upload to our platform. By uploading data, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process the data to provide the services to you, and to aggregate and anonymize the data for the purpose of training and improving our machine learning algorithms.

6. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the platform.
